Defendant accepts deal; case continued

A Sutton man accepted a plea agreement last month in the Fillmore County District Court. Dustin R. Walters, 31, currently incarcerated, pleaded guilty to one count of Attempted Sexual Assault of a Child, a Class 2 felony, on August 13. With the guilty plead, Walters will now have to register with the Nebraska Sex Offenders Registry for the rest of his life.
A Class 2 felony has the possibility of up to 50 years in prison. The incident, which he pleaded guilty to, occurred in December of 2018.
Fillmore County District Court Judge Vicky Johnson ordered a pre-sentence investigation to take place and set the matter down for sentencing on Tuesday, October 8, at 10:45 a.m. A bond hearing also took place and bond was not lowered. Walter’s bond stands at $100,000, 10 percent.
Aaron Ogren, 30, of rural Exeter, also appeared in court last month for the purpose of a pre-trial hearing. Fillmore County Public Defender Brad Kalkwarf requested a continuance on August 13. Ogren is charged with 40 felony counts involving livestock and theft.
“We have just a large amount of discovery in this case,” Kalkwarf said. “Financial records keep coming in…Department of Agriculture reports…I need an additional 60 days just for the volume of things that keep coming in.”
Judge Johnson granted the continuance and Ogren is due back in court on Tuesday, October 8, at 9:45 a.m.
