The ‘drop dead deadline’ for a plea agreement in the 1st degree assault case involving Ervin C. Fuehrer, 60, of Grafton has passed. A new trial date has also been set.
Fuehrer is charged with 1st degree assault, a Class 2 felony, and Using a deadly weapon to commit a felony, also a Class 2 felony, for a March 19 incident involving the shooting of Stephen Preslicka, a half brother of Fuehrer, outside Fuehrer’s residence in Grafton.
Fillmore County District Court Judge had established September 11 as the last day for avoiding the case from going to trial. The defendant’s legal counsel has requested a jury trial. In late August, Judge Johnson set the case for trial in October.
After pre-trial hearings, Judge Johnson has established Wednesday, December 16, at 9 a.m., as the first date of the Fuehrer jury trial. The State of Nebraska Attorney General’s Office is handling the prosecution of this case for Fillmore County.
